Terms of Use

These Terms of Use ("Terms") govern your use of the PaperHero service provided by blaumedia GmbH. Please read them carefully. By subscribing you accept these Terms.

§ 1 Scope and provider

These Terms apply to the PaperHero service, comprising the website at paperhero.io, your customer instance at <id>.customer.paperhero.io, and the PaperHero apps for iOS and Android (the "Service").

Provider and contracting party is blaumedia GmbH, Friedrich-Ebert-Hof 6, 22763 Hamburg, Germany, registered at Amtsgericht Hamburg, HRB 198611, VAT ID DE462180488, represented by its Managing Director Dennis Oliver Paul ("we", "us"). Contact: contact@blaumedia.com, support@paperhero.io.

Deviating terms of the customer do not apply unless we expressly agree to them in writing.

§ 2 Service description

PaperHero lets you upload, scan, store, organize, search and process documents. Features include AI-assisted text recognition (OCR), semantic search, an AI assistant, optional email ingress and multi-user sharing.

The functional scope, page and AI-query quotas and prices depend on the plan you book (currently Trial, Small, Medium and Big) as described on our pricing page at the time of booking.

Document content and AI inputs are processed as described in our Privacy Policy and Data Processing Agreement, including via external AI providers on the Small and Medium plans and, optionally, on AI models we operate ourselves on the Big plan.

We continuously develop the Service and may add, change or discontinue individual features, provided the core functions of your booked plan are not materially reduced during a paid term.

§ 3 Registration and conclusion of contract

Using the Service requires an account and a valid subscription. You must provide accurate information and keep your access credentials confidential.

For bookings via the website, the contract is concluded when you complete payment in the Stripe checkout after accepting these Terms. For bookings via the Apple App Store, the subscription contract is concluded in accordance with Apple's process; for in-app purchases Apple is the seller of record and Apple's terms apply additionally to that payment relationship.

You must be at least 18 years old and have full legal capacity to enter into a contract.

§ 4 Prices and payment

Prices are shown at checkout and are final prices including statutory VAT where applicable.

Website payments are processed by Stripe; payments for in-app purchases by Apple. We do not store full payment-card data.

Subscriptions renew automatically for the booked period (monthly) until cancelled, and you are charged at the start of each period.

§ 5 Trial

The 30-day trial is offered at a reduced price (currently €1) and may be used only once per customer within 365 days. Unless you cancel before the end of the trial, it automatically converts into the Small plan at the then-current price (currently €5.99 per month), which renews monthly until cancelled.

§ 6 Term, renewal and cancellation

The contract runs for the booked period and renews automatically by the same period unless cancelled before the end of the current period.

Website subscriptions can be cancelled at any time with effect from the end of the current billing period — directly in the customer portal (which we also make reachable via a cancellation link) or by emailing support@paperhero.io. Your access continues until the end of the paid period.

Subscriptions purchased via the Apple App Store are managed and cancelled in your Apple Account settings; we cannot cancel them on your behalf.

The right to extraordinary termination for good cause remains unaffected.

§ 7 Right of withdrawal (consumers)

If you are a consumer, you have a statutory right of withdrawal. The full Withdrawal Instructions and the model withdrawal form are set out below in the section 'Withdrawal Instructions'.

Because the Service is made available to you immediately, you expressly request, when booking, that we begin providing the Service before the end of the withdrawal period. For a paid digital service you acknowledge that your right of withdrawal lapses once we have fully provided the service, and that if you withdraw during ongoing provision you owe a proportionate amount for the service used up to that point.

§ 8 Customer obligations and acceptable use

You may not upload or process content that is unlawful, infringes third-party rights or contains malware, and you may not misuse the Service or impair its operation.

You are responsible for the content you upload and for having the rights to process it, including any personal data of third parties contained in your documents. For such data you act as controller and we act as your processor under our Data Processing Agreement.

We may suspend or terminate accounts that materially violate these Terms or applicable law.

§ 9 Content, rights and confidentiality

You retain all rights to the documents and data you upload. We claim no ownership of your content.

You grant us the limited right to store, process and transmit your content solely to provide the Service (including OCR, indexing and the AI features described). Your document content and AI inputs are not used to train AI models.

Documents are stored encrypted, with access controls and per-customer isolation as described in our Privacy Policy.

§ 10 Availability and support

We aim for high availability but do not guarantee uninterrupted operation; maintenance windows and events beyond our reasonable control excepted.

Support is provided by email at the addresses above. You are responsible for keeping your own backups of essential documents.

§ 11 Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health.

For slight negligence we are liable only for the breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), and then limited to the foreseeable damage typical for this type of contract.

Liability under the German Product Liability Act and for any guarantee expressly given remains unaffected.

§ 12 Data protection

We process personal data in accordance with our Privacy Policy. Where we process personal data contained in your documents on your behalf, our Data Processing Agreement (Art. 28 GDPR) applies.

§ 13 Changes to these Terms

We may amend these Terms for a valid reason, such as changes in the law or to the Service. We will notify you of changes by email at least 30 days before they take effect. If you object before the effective date, the contract continues on the previous Terms and we may terminate it with effect from the end of the current term. If you do not object by the effective date, the amended Terms are deemed accepted; we will point this out to you in the notification.

§ 14 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer-protection provisions of their country of habitual residence remain unaffected.

Where permitted, the place of jurisdiction is Hamburg.

We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board (§ 36 VSBG).

Should any provision of these Terms be or become invalid, the validity of the remaining provisions is unaffected.

These Terms are provided in English and German. In the event of discrepancies, the German version prevails for consumers habitually resident in Germany.

Withdrawal Instructions

Right of withdrawal: You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (blaumedia GmbH, Friedrich-Ebert-Hof 6, 22763 Hamburg, Germany, email: support@paperhero.io) of your decision to withdraw by a clear statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

You can also declare your withdrawal directly using the withdrawal button ("Vertrag widerrufen") on our website, available in the footer and at paperhero.io/withdraw.

Consequences of withdrawal: If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than 14 days from the day on which we are informed about your withdrawal, using the same means of payment you used for the original transaction unless expressly agreed otherwise; in no event will you be charged any fees for this reimbursement.

If you requested that the service begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the service already provided up to the time you informed us of your withdrawal, compared with the full scope of the contract. Your right of withdrawal expires for a digital service once the contract has been fully performed, where performance began with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal.
